Welcome to Vikas Disha. These Terms and Conditions (“Terms”) govern your access to and use of the Vikas Disha mobile application, website, and related services (collectively, the “Platform”). Vikas Disha is an employment and recruitment platform that enables job seekers to discover employment opportunities and enables employers and recruiters to publish vacancies, search for candidates, and communicate with potential applicants. By registering for, accessing, or using Vikas Disha, you agree to be legally bound by these Terms. If you do not agree with these Terms, you must not use the Platform.

1. Definitions

For these Terms:

• “Vikas Disha”, “we”, “us”, or “our” means Vikas Disha, the operator of the Platform.
• “User”, “you”, or “your” means any person accessing or using Vikas Disha.
• “Candidate” means a person using Vikas Disha to search for or apply for employment opportunities.
• “Employer” means a company, organization, business, or individual using Vikas Disha to recruit personnel.
• “Recruiter” means a person authorized by an employer or organization to undertake recruitment activities.
• “Job Posting” means a vacancy or employment opportunity published through the Platform.
• “Content” means text, photographs, resumes, job descriptions, logos, documents, messages, videos, and other material submitted or displayed through the Platform.

2. Eligibility

You must provide accurate information when creating an account. You may use the Platform only if you are legally capable of entering into a binding agreement under applicable law. If you use Vikas Disha on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Account Registration

Certain features require registration. You agree to:

• Provide accurate and complete information;
• Keep your information updated;
• Maintain the security of your login credentials;
• Not share your account with unauthorized persons;
• Immediately notify us of unauthorized account access;
• Accept responsibility for activity occurring through your account where attributable to your actions or negligence.

We reserve the right to suspend or terminate accounts containing false, misleading, fraudulent, or unauthorized information.

4. Candidate Responsibilities

Candidates are responsible for ensuring that:

• Their resumes are accurate;
• Educational qualifications are genuine;
• Employment history is truthful;
• Skills and certifications are accurately represented;
• Job applications contain truthful information;
• Uploaded documents belong to them or are used with appropriate authorization.

You must not impersonate another person or falsely represent your qualifications or employment history.

5. Employer and Recruiter Responsibilities

Employers and recruiters agree that job postings must:

• Represent genuine employment opportunities;
• Contain accurate information;
• Clearly describe the position;
• Provide truthful salary and employment information where required;
• Comply with applicable employment laws;
• Not discriminate unlawfully;
• Not request prohibited or unnecessary personal information;
• Not contain fraudulent or misleading claims.

Employers must not use Vikas Disha for illegal recruitment, scams, money laundering, trafficking, or other unlawful activities.

6. Job Listings

Vikas Disha provides technology that allows employers and recruiters to publish job opportunities. We do not guarantee:

• That a job will remain available;
• That a job description is accurate;
• That an employer will respond to an application;
• That an applicant will be hired;
• That an employer will conduct an interview;
• That a candidate is suitable for a position;
• That any particular salary or employment condition will be offered.

Vikas Disha is not the employer of candidates applying through the Platform unless expressly stated otherwise.

7. No Employment Guarantee

Vikas Disha is a technology platform connecting candidates and employers. Using Vikas Disha does not create:

• An employment relationship between Vikas Disha and a candidate;
• An agency relationship between Vikas Disha and a candidate;
• An employment relationship between Vikas Disha and an employer’s employees;
• Any guarantee of employment.

Hiring decisions are made independently by employers.

8. Candidate-Employer Communications

Vikas Disha may provide messaging, contact, interview, or application features. Users must communicate professionally and lawfully. Users must not use the Platform to:

• Harass another person;
• Send threats;
• Send spam;
• Distribute malware;
• Request passwords or OTPs;
• Request unnecessary financial information;
• Conduct fraudulent schemes;
• Send sexually explicit or abusive material;
• Discriminate unlawfully;
• Promote illegal activities.

Vikas Disha may restrict communication features where misuse is detected or reported.

9. Resume and Profile Content

Candidates retain ownership of content they submit, subject to the rights necessary for Vikas Disha to operate the Platform. By uploading a resume or professional profile, you grant Vikas Disha a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, transmit, and process that content as reasonably necessary to provide the Platform’s services. This may include making your profile or resume available to employers or recruiters according to your selected visibility settings.

10. Employer Content

Employers retain ownership of their job descriptions, logos, company information, and other content they submit. By submitting such content, employers grant Vikas Disha permission to host, display, reproduce, format, distribute, and promote that content for operating and marketing the Platform, subject to applicable law and the employer’s selected settings.

11. Prohibited Activities

You must not:

1. Create fake accounts;
2. Impersonate another person or organization;
3. Submit false qualifications;
4. Publish fake job vacancies;
5. Post fraudulent employment opportunities;
6. Collect candidate information for unauthorized purposes;
7. Sell or commercially exploit candidate information obtained through Vikas Disha without authorization;
8. Scrape or systematically extract Platform data without written permission;
9. Reverse engineer the Platform;
10. Attempt to bypass security measures;
11. Introduce malware, viruses, or malicious code;
12. Interfere with Platform operations;
13. Attempt unauthorized access to accounts or systems;
14. Use automated bots without authorization;
15. Send spam;
16. Harass or threaten other users;
17. Discriminate unlawfully;
18. Use the Platform for illegal activities;
19. Upload content that infringes intellectual property rights;
20. Upload obscene, defamatory, threatening, or unlawful content;
21. Misrepresent an affiliation with Vikas Disha;
22. Use another person’s account without authorization;
23. Circumvent Platform restrictions or bans.

12. Fraud Prevention

We may monitor Platform activity and investigate suspected fraud, abuse, or violations of these Terms. We may verify accounts, request additional information, restrict accounts, remove job postings, remove user content, restrict messaging, suspend accounts, permanently terminate accounts, or report suspected unlawful activity to appropriate authorities. We do not guarantee that all fraudulent activity will be detected or prevented.

13. Verification

Vikas Disha may offer employer, recruiter, candidate, or company verification features. Verification does not constitute a guarantee that a user or organization is trustworthy, financially capable, legally compliant, or suitable for employment. Users should conduct their own due diligence.

14. Payments and Paid Services

Certain features may be offered on a paid basis. Prices, subscription periods, taxes, renewal terms, and applicable conditions will be displayed before purchase where required. Payments may be processed through third-party payment providers. Unless otherwise stated, fees are payable according to the applicable pricing plan, access depends on successful payment, taxes may be charged as required by law, and refunds are handled according to the applicable refund policy. Vikas Disha may modify pricing in the future, subject to applicable law and appropriate notice.

15. Subscriptions

If Vikas Disha offers subscriptions, subscriptions may automatically renew if this is clearly disclosed and enabled. You are responsible for cancelling a subscription before its renewal date if you do not wish to continue. Specific subscription cancellation and refund terms may be provided at the time of purchase.

16. Intellectual Property

The Vikas Disha Platform, including its name, logo, branding, software, user interface, design, graphics, text, features, algorithms, databases, and compilation of content, is owned by or licensed to Vikas Disha and is protected by applicable intellectual property laws. Except as expressly permitted, you may not copy, reproduce, modify, distribute, sell, lease, reverse engineer, or commercially exploit any part of the Platform.

17. Third-Party Services

Vikas Disha may integrate with third-party services, including authentication providers, cloud services, payment gateways, maps, analytics services, communication providers, and social login providers. Third-party services may have their own terms and policies. Vikas Disha is not responsible for third-party services outside its reasonable control.

18. Platform Availability

We aim to keep Vikas Disha available and functional but do not guarantee uninterrupted availability. The Platform may temporarily become unavailable because of maintenance, updates, technical failures, network problems, cybersecurity incidents, third-party service failures, force majeure events, government restrictions, or other circumstances beyond our reasonable control.

19. User Content

You remain responsible for content you upload or submit. You represent that you have the necessary rights to submit the content, it is accurate to the best of your knowledge, does not violate applicable law or third-party rights, and does not contain malicious software. We may remove content that violates these Terms or applicable law.

20. Privacy

Your use of Vikas Disha is also governed by our Privacy Policy. The Privacy Policy explains how we collect, use, store, disclose, and protect personal information. By using the Platform, you acknowledge the processing described in the Privacy Policy, subject to applicable law.

21. Data Protection

Vikas Disha will handle personal data in accordance with applicable data protection laws. Users are expected to use personal information obtained through Vikas Disha only for legitimate and lawful purposes. Employers and recruiters must not misuse, sell, unlawfully disclose, or unnecessarily retain candidate information obtained through the Platform. The Digital Personal Data Protection Rules, 2025 establish requirements concerning notices, personal-data processing, security safeguards, and related obligations, with provisions coming into force according to the Government’s notified phased timeline.

22. Reporting Violations

Users may report fake jobs, fraudulent recruiters, suspicious accounts, harassment, abuse, inappropriate content, privacy violations, copyright violations, or other violations of these Terms.

23. Account Suspension and Termination

We may suspend or terminate an account if these Terms are violated, false information is provided, fraud is suspected, the account poses a security risk, the Platform is misused, required by law, or used for unlawful activity. You may stop using Vikas Disha at any time. Termination does not automatically remove obligations that accrued before termination.

24. Disclaimer

Vikas Disha provides an employment technology platform and does not guarantee the accuracy, completeness, legality, quality, safety, or reliability of all information submitted by users. We do not guarantee employment, interviews, job offers, candidate suitability, employer suitability, salary, job availability, recruitment outcomes, or accuracy of user-submitted information. Users are responsible for conducting appropriate verification and due diligence.

25. Limitation of Liability

To the maximum extent permitted by applicable law, Vikas Disha and its officers, employees, affiliates, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive losses arising from or relating to your use of the Platform. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

26. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Vikas Disha, its affiliates, directors, officers, employees, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from your violation of these Terms, unlawful use of the Platform, content, violation of another's rights, fraudulent activity, or breach of applicable law.

27. Changes to the Platform

We may modify, add, suspend, or remove Platform features, as well as update these Terms to reflect changes in law, services, new features, security, or business requirements. Continued use after updated Terms become effective constitutes acceptance.

28. Governing Law

These Terms shall be governed by the laws of India. Subject to applicable law, disputes shall be subject to the jurisdiction of the courts located in Kolar, Karnataka, India.

29. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue to remain in effect to the extent permitted by law.

30. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms applicable to specific services, constitute the agreement between you and Vikas Disha concerning your use of the Platform.
